These Terms govern your use of Hyper, including its app, website, APIs, and related services (the "Service"), operated by Yuri Koshiishi ("we," "us," or "our"). By using the Service, you agree to these Terms.

The Service and Eligibility
The Service generates hypertrophy training programs and helps you record and review your workouts. Paid features require a subscription. Available features and purchase conditions are described in the app.
If you are not legally able to enter into these Terms on your own, you must have the permission of your parent or legal guardian.
Fitness Information and Exercise Safety
The Service provides fitness information and training tools, not medical advice, diagnosis, or treatment. Generated programs, set and load suggestions, rep-max estimates, volume recommendations, and other calculations are based on the information you provide, may be incomplete or inaccurate, and do not guarantee particular results.
Choose exercises, loads, and training intensity appropriate to your abilities and circumstances. Exercise involves a risk of injury. Seek advice from a qualified healthcare professional when needed, particularly if you have a medical condition or concerns about exercising safely. Stop exercising and seek appropriate help if you experience pain, dizziness, or other concerning symptoms.
Accounts and Security
Provide accurate account information and keep your sign-in credentials secure. Do not share or sell your account, impersonate another person, or access someone else's account without permission. Contact us promptly if you suspect unauthorized access. You are responsible for your use of the Service, subject to protections provided by applicable law.
Software License and Intellectual Property
You may use the Service for its intended fitness purposes in accordance with these Terms. We and our licensors retain the rights in the Service's software, design, exercise and program materials, and branding, apart from content belonging to you or others.
For apps downloaded through Apple's App Store, Apple's standard End User License Agreement applies unless a custom license is supplied through the store. These Terms supplement the applicable software license. You may not copy, modify, distribute, resell, sublicense, reverse engineer, decompile, disassemble, or attempt to extract the source code of the Service except as expressly permitted by us, applicable law, or the relevant software license, including licenses for open-source components.
Acceptable Use
You must not use the Service, or help anyone else use it, to:
- violate the law or infringe another person's intellectual property, privacy, or other rights;
- harass others, send spam, distribute malware, or submit fraudulent information;
- gain unauthorized access to accounts, data, systems, or networks;
- disrupt, damage, or overload the Service, including through denial-of-service or distributed denial-of-service (DoS/DDoS) attacks, request flooding, or deliberately excessive traffic;
- bypass authentication, access controls, security measures, rate limits, paid-feature restrictions, or other usage limits;
- scrape, bulk-extract data, create accounts automatically, or access the Service's APIs through unauthorized bots, scripts, or automated clients, except through integrations or features we expressly permit;
- probe or test the security of the Service without our authorization, except where permitted by applicable law;
- exploit bugs, manipulate purchase or subscription information, or use multiple accounts to obtain benefits you are not entitled to or evade restrictions.
These restrictions do not prevent use of supported accessibility tools, authorized integrations, or the Service's own sharing features. Report suspected security vulnerabilities privately to [email protected].
Your Content
You retain your rights in the workouts, notes, and other content you provide. You must have the permissions needed to submit that content. You authorize us to store, process, reproduce, and transmit it as needed to provide, support, and protect the Service and carry out your instructions. This permission does not grant us a general right to sell your content or publish your private workout records.
Your workout records are currently stored only on your device. Uninstalling the app or clearing its data deletes them, and we cannot restore them.
Personal information is handled as described in our Privacy Policy. Permission to process content under these Terms does not replace separate consent where required.
Purchases, Subscriptions, and Refunds
Before you confirm a purchase, the purchase screen and App Store checkout show the price, applicable taxes, billing interval, included benefits, and any trial or promotional conditions. Payment is handled by the Apple Account used for the purchase. Paid access becomes available after the purchase is confirmed; if it does not activate, use the app's restore option or contact us.
Subscriptions renew automatically for the displayed billing period until canceled. Initial charges and renewal charges follow the conditions shown by the App Store. If a free or discounted trial is offered, it converts to the displayed paid subscription unless canceled before the stated deadline. Price changes are communicated, and consent obtained, when required by the App Store or applicable law.
Manage or cancel in your device's Settings → your name → Subscriptions → Hyper. Cancel at least 24 hours before the current period or trial ends to avoid renewal. See Apple's cancellation instructions.
Cancellation normally stops future renewals while paid access continues until the end of the paid period, subject to the App Store's rules. Trial access may end earlier under the App Store's terms. Deleting the app or requesting account deletion does not cancel a subscription or automatically create a refund.
For refunds, use Apple's refund request service. Eligibility depends on the purchase, Apple's rules, and applicable law; cancellation alone does not guarantee a refund for the current period. Nothing in these Terms excludes mandatory refund or consumer rights.
Third-Party Services
The App Store, sign-in providers, and other third-party services have their own terms. We are responsible for our Service; those providers are responsible for their own services.
Suspension, Termination, and Account Deletion
We may block requests, limit features, or suspend or terminate access when reasonably necessary to address a material breach of these Terms, abuse, fraud, security risks, or legal requirements. We may act immediately to protect the Service or others. Where appropriate, we will explain the reason and provide a way to contact us, unless doing so would create a security risk or be prohibited by law.
You may stop using the Service at any time and delete your account through the app's account settings or contact us for assistance. Our Privacy Policy explains what account deletion does and how to request permanent erasure. Any restriction or termination of paid access remains subject to the purchase terms and mandatory consumer rights.
Availability and Changes
The Service requires a compatible iPhone, software updates, and an internet connection for sign-in, purchases, and some other features. You are responsible for your internet and mobile-network charges. Maintenance, outages, and third-party failures may interrupt access.
We may change or discontinue features. For changes materially affecting existing paid access, we will provide notice and any remedies required by the purchase terms or applicable law.
Disclaimers and Liability
We use reasonable care in providing the Service but cannot promise uninterrupted or error-free operation, complete accuracy, or particular fitness outcomes. Except for our express commitments and warranties required by law, the Service is provided as available.
To the extent permitted by applicable law, we are not responsible for indirect or consequential losses arising from use of the Service. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including mandatory consumer protections and liability for intentional misconduct or gross negligence.
Governing Law and Disputes
These Terms are governed by the laws of Japan. Contact us first so we can try to resolve any concern. Subject to mandatory law, the Tokyo District Court has jurisdiction over disputes concerning the Service. If you are a consumer, this does not remove protections under mandatory laws where you live or any right to bring proceedings in your local courts.
Changes to These Terms
We will publish updates with a revised date and notify you of material changes through an appropriate channel. Where advance notice or consent is required, we will provide it or obtain it before the change takes effect. If a provision is unenforceable, the remaining provisions continue to apply to the extent permitted by law.
